Terms and Conditions

Important Fees:

• Delivery: Free within a 20km driving distance of Ellerslie Racecourse

• Bond: $100

• Monthly Rental: $90 

• Return Collection: Free within a 20km driving distance of Ellerslie Racecourse

Payment Frequency:
The bond and first month’s rental are due at the start of the contract. Ongoing rental payments are due monthly on the calendar date the Equipment was delivered.

1. Term of Hire

1. The minimum hire term is three (3) months.

2. After the initial term, the hire automatically continues on a month-to-month basis.

3. If the Equipment is returned early, the full minimum term remains payable, or an early exit fee of $150 will apply (whichever is the lesser amount).

4. A minimum of seven (7) days’ notice is required to end the hire.

2. Obligations of Gym Equipment NZ

Gym Equipment NZ will:

1. Allow the Customer to use the Equipment for the hire period.

2. Supply the Equipment clean and in good working order.

3. Collect the Equipment within seven (7) days after the notice period expires.

4. Refund the bond within seven (7) days of the Equipment being returned, less any amounts owing for damage, cleaning, unpaid hire, or other costs under this Contract.

3. Obligations of the Customer

The Customer must:

1. Always keep the equipment indoors. 

2. Have the Equipment ready for collection when due.

3. Return the Equipment clean and in good repair.

4. Satisfy themselves of the suitability of the Equipment at the commencement of the hire.

5. Operate the Equipment safely, legally, and only for its intended purpose.

6. Indemnify Gym Equipment NZ for any injury, loss, or damage arising from use of the Equipment.

7. Ensure any person accepting delivery is authorised to do so.

8. Use adequate and appropriate power sources (where applicable).

9. Immediately report any accident, fault, or damage.

The Customer must not:

• Tamper with, damage, or attempt to repair the Equipment. Fair wear and tear resulting from normal, careful use is accepted. Damage caused by misuse, neglect, improper storage, or failure to follow instructions is not considered fair wear and tear.

• Lose possession of, lend, or transfer the Equipment to any other party.

• Rely on any representations not contained in this Contract.

• Allow minors to play on or use the Equipment.

4. Assignment

This Contract is personal to the Customer and may not be assigned.

5. Payments

The Customer must pay all hire charges as agreed.

If payments are overdue, Gym Equipment NZ may suspend the hire, terminate the Contract, and repossess the Equipment.

The Customer must immediately pay on request:

• Replacement cost for any Equipment not returned.

• Cleaning and repair costs.

• Late payment fees charged at 3% per month.

6. Ownership

All Equipment remains the sole property of Gym Equipment NZ at all times.

7. Equipment Security

The Equipment must be kept in a securely locked property at all times.

8. Liability

To the fullest extent permitted by law, Gym Equipment NZ is not liable for any indirect or consequential loss, injury, or damage arising from the use of the Equipment.

9. Breach

If the Customer breaches this Contract or becomes insolvent, Gym Equipment NZ may:

• Terminate the Contract.

• Recover all outstanding monies.

• Repossess the Equipment (with authority to enter the premises where it is located).
